Q: I’m filing for divorce, I bought our home prior to the marriage and it is still in my name only. Would my wife be entitled to any of the equity in this property?
A: Of course there are always exceptions, but generally speaking it would be an uphill battle for your wife to be successful in receiving some portion of the equity of the marital home. That being said, depending on the length of the marriage and if she can establish contributions to the increase in equity the Court may be open to some consideration for her.
