What are QRDO's
QDRO’s are the general name for specialized orders drafted for the sole purpose of dividing a participant’s retirement account in compliance with the parties’ state court divorce, separation, alimony, and/or child support orders.
How does a QRDO Lawyer help?
A QDRO lawyer can assist both or either the plan participant or alternate payee in determining if a QDRO or similar document is needed to divide the participant’s retirement plan. Further, the lawyer can draft the required documentation in compliance with the Employment Retirement Income Security Act “ERISA”, seek pre-approval if available, and assist in filing the required documentation with the state court and plan administrator.
Tips
When meeting with one of our QDRO lawyers, it is best to have a current copy of any state court divorce, separation, alimony or child support order dividing the plan, a recent retirement plan statement, and any additional contact and identifying information regarding the plan participant and alternate payee.
