A: Delaware, like all 50 states, has adopted the Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA). This is the law that governs where custody disputes may be filed. Generally, custody petitions may be filed in the “home state” of the child, which is defined as the state where the child has lived for the 6 months immediately preceding the filing.
